GENERAL TERMS & CONDITIONS (GTC) OF ENPERSO LESIURE TRAVEL – A DIVISION OF ENPERSO PTY LTD

Please take the time to read and understand the GTC set out below prior to booking a trip with us. We strongly recommend that you carefully read all information relating to your trip on our website prior to booking to ensure that you understand the itinerary, level of comfort and physical demands of the trip you are undertaking.

OUR CONTRACT

All bookings are made with EnPerSo Leisure Travel, owned and operated by EnPerSo Pty Ltd. By booking a trip with us in writing, by telephone, electronically (online), or in person, you are bound by these Booking Conditions (which constitute the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation and invoice.

It is the customer’s responsibility upon receipt of an invoice and/or confirmation to check that the information on it is complete and correct. Any inaccuracies must be immediately reported to EnPerSo Leisure Travel. Costs arising from a failure to report such inaccuracies shall be borne by the customer.

Services that are not arranged or provided by EnPerSo Leisure Travel are governed by the terms and conditions of carriage and the general terms and conditions of the service provider concerned.

VALIDITY

Flight tickets are generally valid only for transport on the airlines for which they were purchased. Transfers of bookings to other airlines and changes in itineraries or additional stopovers are not possible during the customer’s journey.

Flight tickets must be fully used in the booked order. Failure to use certain flight routes may result in the loss of the customer’s right to travel on all booked flights, or in the airline re-invoicing the ticket price. EnPerSo Leisure Travel is not responsible for fees or penalties imposed under such circumstances.

YOUR DETAILS

In order for us to confirm your travel arrangements, you must provide all requested details when booking your trip. Necessary details include full name as per passport, date of birth, nationality, passport number, passport issue, and expiry date, and any pre-existing medical conditions you have that may affect your ability to complete your travel arrangements.

Your booking cannot be confirmed without the provision of these details.

CANCELLATION BY THE TRAVELLER

If you cancel some or all portions of your booking, cancellation fees will apply. A cancellation will only take effect once we receive written notice of cancellation.

At the time of booking, we will advise you of the applicable cancellation charges. Some bookings may incur a 100% cancellation fee immediately upon confirmation and ticket issuance. Please note, changes to cancellation policies or fees imposed by third-party providers are outside our control, and we are not liable for such changes.

We strongly recommend that you take out cancellation insurance at the time of booking to cover potential cancellation fees. If you choose to leave a trip for any reason after it has commenced, we are not obligated to provide refunds for unused services.

SCHEDULE OF FEES

We’re proud to offer our standard booking services with no additional booking or service fees. Fees do apply for changes and cancellations, and supplier or airline fees may also apply in addition to those listed below.

  • Deposits: All deposits paid to EnPerSo Leisure Travel are non-refundable.
  • Change Fee: $50 per person, plus any applicable supplier or airline fees.
  • Cancellation Fee: $250 per person, plus any applicable supplier or airline fees.

PRICES

All prices are subject to availability and may change without prior notice. A quoted price is only guaranteed once your booking has been paid in full and confirmed.

Prices may vary due to factors beyond our control. These may include, but are not limited to, currency fluctuations, fuel surcharges, changes in taxes or levies, and increases imposed by airlines or accommodation providers.

In some cases, prices quoted are based on ‘Instant Purchase’ rates due to the dynamic nature of travel product availability. These rates are only confirmed once full payment is received and processed. On rare occasions, due to the rapid pace of supplier pricing changes, a quoted fare or rate may become unavailable between your payment and final booking confirmation. If this occurs, we will notify you as soon as possible and offer you comparable alternatives or a full refund.

We recommend checking with your consultant for the most current pricing. We do not guarantee that our prices will always be equal to or lower than those advertised directly by airlines or suppliers.

PASSPORT AND VISAS

You must carry a valid passport and have obtained all appropriate visas, permits and certificates for the countries you will visit during your trip. While passport validity requirements may differ between countries, we strongly recommend your passport be valid for 6 months beyond the duration of the trip.

It is your responsibility to ensure that your travel documentation is valid and complete. We are not responsible if you are refused entry to a country due to incorrect documentation. You can refer to the smartraveller website for details.

TRAVEL INSURANCE

All travellers are required to have personal travel insurance, which you are responsible for obtaining. Your policy should include cover for personal accident, death, medical expenses, and emergency repatriation, with a recommended minimum coverage of AUD$200,000 for each category.

We also strongly recommend that your policy covers cancellation, curtailment, personal liability, and loss of luggage or personal effects.

If you are travelling on a guided tour, your tour leader may collect your travel insurance details at the start of the trip. We encourage you to review the terms and conditions of your policy to ensure comprehensive coverage.

ACCEPTANCE OF RISK

You acknowledge that certain aspects of your trip may include adventurous components, and participation involves a degree of personal risk. You may visit places where political, cultural, and geographical conditions present dangers and challenges greater than those in daily life.

While we use information from government foreign departments and our own contacts in assessing whether the itinerary should operate, it is your own responsibility to acquaint yourself with relevant travel information and the specific nature of your itinerary. You acknowledge that your decision to travel is made in consideration of this information, and you accept that you are aware of the personal risks associated with such travel. LIMITATION OF LIABILITY AND INDEMNITY

To the maximum extent permitted by law, EnPerSo Leisure Travel is not liable for any loss, damage, or non-performance arising from:

  • A failure to act on the side of the customer.
  • An unforeseeable and unavoidable omission by a third party not involved in providing the contractually agreed services.
  • Force majeure events or circumstances that EnPerSo Leisure Travel or its service providers could not have foreseen or avoided, even with due care.

This includes, but is not limited to, changes in itineraries caused by strikes, social unrest, weather conditions, authority decisions, third-party delays, flight schedule disruptions, or other service interruptions beyond our control.

Additionally, EnPerSo Leisure Travel is not liable for:

  • Errors or omissions in website content, pricing changes, or discontinued services.
  • Loss or damage resulting from the customer’s use of the Booking Services.
  • Any claims arising from incorrect information provided by the customer, including the disclosure of personal information.

To the extent permitted under the Australian Consumer Law, our liability will be limited, at our discretion, to:

  • The supply of equivalent booking services; or
  • The payment of the cost of the booking services.

In all cases, our liability shall not exceed the amount actually paid by you for the services provided by us.

You agree to indemnify and hold EnPerSo Leisure Travel harmless from any claims, losses, or damages arising from your breach of this agreement, including providing incorrect information or failure to comply with these terms.

IF THERE IS A DISPUTE

If you have concerns or dissatisfaction with a travel service provided, we encourage you to refer to our Complaints Handling Policy for guidance on lodging a complaint and resolution processes before proceeding with formal dispute escalation.

If a dispute does arise, you acknowledge and agree that confidentiality is paramount to our reputation. Neither party shall publish or disclose dispute-related communications on social media or public forums. Any breach of this clause will be subject to legal remedies, including compensation claims.

In the event of any dispute that cannot be resolved, both parties agree to obtain an independent professional arbitrator/dispute resolution specialist to make a determination on the dispute and each party agrees to pay their own costs.

EnPerSo Leisure Travel is a proud to hold ATIA Accreditation, ATIA is an industry accreditation scheme that sets the benchmark of quality for the travel industry. ATIA is also responsible for monitoring our compliance with the ATAS Code of Conduct (the Code) and assisting in the resolution of complaints.  If you would like to know more about the Code, you can visit the ATAS website www.atas.com.au.

SEVERABILITY

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

PRIVACY POLICY

Personal information collected will be handled in accordance with our Privacy Policy, which complies with the Australian Privacy Principles and GDPR where applicable. The Privacy Policy is available on our website, and we recommend reviewing it before booking.

JURISDICTION

The relationship between customers and EnPerSo Leisure Travel is governed exclusively by Australian law.

OTHER

This Agreement constitutes the entire agreement between you and us, superseding all prior agreements, proposals, and communications, whether oral or written. In the event of any inconsistency between these Terms and other terms and conditions on our website, these Terms will prevail.

No additional terms will be included in this Agreement unless required by law. Our failure to exercise any right or enforce any provision of this Agreement does not constitute a waiver of that right or provision in the future.

If any provision of this Agreement is deemed unenforceable under applicable law, that provision will be severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. All obligations and liabilities under this Agreement, including indemnities, shall survive termination or completion of services provided under this Agreement.
